These Terms and Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity (“You”), and Marlin Motocorp Private Limited (“Marlin Motocorp,” “We,” “Us,” or “Our”), governing your use of our website www.marlinmotocorp.com, related mobile applications, and associated services (collectively, the “Site”).

By accessing the Site or using our services, You agree to these Terms and Conditions. If You do not agree, You are expressly prohibited from using the Site and must discontinue use immediately. Supplemental terms or agreements may apply to specific services, which are incorporated by reference.

 

1. Intellectual Property Rights

All content on this website, including text, graphics, interfaces, artwork, and code is owned or licensed by Marlin Motocorp and is protected under applicable intellectual property laws. You are granted a limited license to access and use the Site for personal, non-commercial purposes. Unauthorized use of the Content is prohibited.

Trademarks, logos, and service marks displayed are the property of Marlin Motocorp or third parties and require prior permission for use. You may not reproduce, distribute, or use any content without authorization from Marlin Motocorp or the respective owners. Any violation of these terms may result in legal action, and you will bear the liability.

  • Engaging in unauthorized data scraping, data extraction, or data harvesting.

  • Misrepresenting your identity or affiliation.

  • Violating intellectual property rights or breaching others' privacy.

Engaging in such activities could lead to account suspension, permanent banning, or legal action.

While this content is sourced from entities believed to be reliable, Marlin Motocorp does not guarantee its accuracy or Marlin Motocorp shall not be held liable for any loss suffered by You based on Your reliance on or use of such data.

5. Report Abuse

In the event You come across any abuse or violation of these Terms of Use or if You become aware of any objectionable content on the Website, please report to Marlin Motocorp’s Customer support.

 

6.Registration and Test Rides

Marlin Motocorp provides an option to schedule test rides of its Retrofit Kits at designated showrooms. To register:

  • You must provide a valid driver’s license and accurate contact details.

  • Ensure accurate submission of scheduling information.

Marlin Motocorp is not liable for missed communications resulting from user errors or technical malfunctions.

7. Booking Terms and Pre-Order Process

  • Booking Amount: A refundable booking amount of ₹999 is required. An additional refundable  advance of ₹5,000, treated as a crowdfunding contribution, supports development efforts. Contributors will receive regular updates on the project’s progress.

  • Pre-Order Registration: Pre-orders are accepted with nominal registration fees. Pre-ordering does not guarantee delivery within a specified timeframe but reserves Your place in the production queue.

  • Final Price: The Retrofit Kit’s price will be determined at delivery time. Marlin Motocorp reserves the right to adjust pricing due to regulatory or market conditions.

  • Payment Methods: Payments can be made via secure online gateways. Marlin Motocorp is not liable for unauthorized data interception.

 

8. Delivery and Installation

  • Estimated Delivery: Estimated delivery timelines will be communicated at the time of booking. Any delays due to unforeseen circumstances, including regulatory or supply chain issues, will be promptly notified.

  • Installation Costs: Additional charges may apply for the installation of charging equipment. Customers are responsible for obtaining necessary permissions or permits for equipment setup at their designated location.

Delivery will be completed only upon full payment, including taxes, fees, and applicable subsidies.

9. Cancellation and Refund Policy

  • Customer Cancellations: Cancellations are allowed prior to completing full payment. The ₹999 booking fee is non-refundable. Thereafter refunds for the advance amount (₹5,000) will be processed within 15 - 30 business days of receiving a valid cancellation request.

  • Marlin Cancellations: Marlin Motocorp may cancel bookings due to unforeseen circumstances such as regulatory changes, lack of availability in Your region, or breach of terms by the Customer.

  • Non-Refundable Cases: If Purchase agreement is finalized with your concern and documentation, no refunds will be provided for cancellations.

 

10. Privacy Policy

By using the Site, You consent to Marlin Motocorp’s Privacy Policy available at Privacy Policy. This includes the collection, storage, and use of personal data. Marlin Motocorp adheres to data protection laws and ensures confidentiality.

 

11.Modifications and Service Disruptions

Marlin Motocorp reserves the right to:

  • Modify, suspend, or discontinue parts of the Site at its discretion without prior notice.

  • Temporarily suspend services for maintenance or technical upgrades.

We endeavor to provide uninterrupted service but are not liable for losses due to service interruptions or modifications.

 

12. Governing Law and Dispute Resolution

  • Applicable Law: These Terms are governed by the laws of India, specifically Karnataka.

  • Dispute Resolution:

    • Informal Negotiations: Parties will attempt to resolve disputes through negotiation within 30 days of notification.

    • Arbitration: Unresolved disputes will be referred to binding arbitration in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996.

    • Jurisdiction: Any legal action will be filed in the courts of Bengaluru, Karnataka.

 

13. Indemnification

You agree to indemnify and hold harmless Marlin Motocorp and its affiliates, employees, and agents from any liabilities, losses, or damages arising from:

  • Your use of the Site or services.

  • Violation of these Terms.

  • Any third-party claims stemming from unauthorized actions.

14. Feedback and Information

Any feedback submitted to this website will be considered non-confidential, and Marlin Motocorp may use it freely. By providing feedback, you confirm that it does not contain confidential or proprietary information from you or third parties, Marlin Motocorp has no obligation of confidentiality regarding the feedback, similar ideas may already be under consideration or development, and you will not receive any compensation or reimbursement for the feedback under any circumstances.

The Site and its content are provided “AS IS” and “AS AVAILABLE.” Marlin Motocorp disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Marlin Motocorp is not liable for:
